Can a software professional apply for H1 visa whose immigration file has already been put up by his brother who is US citizen?

Best startegy is to consult a immigration lawyer. Else try applying for a job in a software company and after selection tell them your situation. Their lawyer will know whether you can apply fro H1 or not.

One very important thing about immigration and other visa related issues : Never ever go on hear-say.. Always get a confirmed answer from some knowledgable source like an immigration attorney or a web site as mentioned above. Again every situation described in such web sites does not necessarily apply to your sepcific case.

I say all this because a friend has suffered due to going on hear-say!
