Google assists in arrest of Indian who posted against Sonia Gandhi

Gurgaon techie held for posting derogatory messages against Sonia Gandhi on Orkut


Pune, May 17 You can have an opinion about anyone in a free country like India, even someone as important as Sonia Gandhi, but if you are not careful about the way you give expression to it, you could land in serious trouble.

This is precisely what happened to 22-year-old IT professional Rahul Krishnakumar Vaid from Gurgaon, Haryana who was arrested by the Pune police for posting derogatory content about Congress chief Sonia Gandhi and Mahatma Gandhi on an orkut community named — “I hate Sonia Gandhi”.


Interestingly, the person who formed this community is not guilty as per the law. The police said that hating Sonia Gandhi is a personal opinion of the person who formed the community and having a personal opinion about someone is not an offence as per the law.


Vaid was charged under section 292 of Indian Penal Code and section 67 of the Information Technology Act because he created a profile and then posted content in vulgar language about Sonia Gandhi in the community.
Amol Bhokare, a Congress activist from Pune had lodged a complaint with Deccan Gymkhana police station against unknown persons in December 2007.


During investigations, the cyber crime cell of Pune police communicated with the Google company seeking details about the who formed this forum and circulated the obscene content. It was known that the vulgar message about Sonia Gandhi was circulated through an email address – Rahulvaidindia@gmail.com . The owner of the email id Rahul Vaid was traced to Chakarpur in Gurgaon city of Haryana.


Deputy Commissioner of Police Sunil Phulari dispatched a team of cyber crime cell comprising of assistant commissioner Netaji Shinde, assistant inspector Chandrakant Thakur, constables Navnath Walke and Sunil Shelke to Haryana.


The police team nabbed Vaid at his residence on Friday evening. The accused was brought to Pune by flight and produced before the Shivajinagar court on Saturday. Vaid has been remanded to police custody till May 21. If proved guilty, Vaid could be imprisoned for up to five years and may have to pay a fine up to Rs one lakh.
During interrogations, Vaid told the police that he posted the message because he hated Sonia Gandhi and was not aware that it would lead to a police case.


Vaid is a commerce graduate and was working in the hardware department of an IT company in Gurgaon.

Whao..what promptness ..is this issue worth wasting tax payer's money and time of Police forces .the guy posted an opinion about somebody which is not a crime ..this way , many echarchan veterans will be behind bars for posting zagainst Sonia

It would be better if our police utilizes it's resources in preventing terrorist attacks and preventing crimes rather than wasting time in such frivolous non-issues

if the language used by the chap arrested was abusive/derogatory then he must go behind bars, we have freedom of expression as our fundamental right but not to abuse someone.....that said, sonia gandhi/congressmen and police should have lot of other things on priority than tracking and arresting a guy who got carried away in expressing his anger towards sonia/congress on internet.

If that is the case then 80% of the population living on the streets of India will have to be put behind bars... which is rather a moot point... as, India (or this life, if you tend to be philosophical about it) itself is a jail and we are already behind bars

Nothing new here. In the near past, the Bombay police had made several arrests of pranksters posting defamatory content about Chatrapati Shivaji, Ambedkar & noted leaders.

A deal was reached between the authorities & Orkut last year wherein Google would provide details of the ip address from which an objectionable message or blog has been posted on the site and the Internet service provider involved. More info here:

Coolbhai's link ... intent behind the law is applaudable. But if Indian politicians are going to implement the law to stifle freedom of expression ... no good.

This reflects bad ... does not look good for my idol Madam Sonia Gandhi and the Nehru dynasty. Nehru spent entire life fighting for freedom ... our freedom ... so we Indians can breath the fresh aroma of freedom and drink fresh drops of morning dew.

She ought to come out and put an end to this madness. She will gain many admirers from among her critics ... if she intervenes in this case. I am sure she reads the newspapers.

I have always admired Sonia Gandhi and Nehru clan ... they provide India with political stability. I also admire her for her love of Indians. She is born Italian. She can easily go back to Italy to live a life of luxury. But ... instead ... she has dedicated her life to serve the poor of India.

In a country as corrupt as India ... Soniya Gandhi and Rahul Gandhi provide a glimmer of hope and dreams of a billion people.

I know many among us are critical of Congress party ... come on guys ... let's be fair ... you got to credit Congress and its leadership for the economic boom Indians are having. Hundreds of millions of Indians are wrestling out of shackles of poverty to join masses of middle class. Who do you give credit? I give credit to Nehru clan and the Congress party. If it was not for them India would have been lost to poverty.

I was very uncomfortable that Congress joined with leftists and communists to form the government. But now that I am having 2nd thoughts ... we are Indians irrespective of our social and political leanings. I am for sure that good of India is in the heart of every Indian including leftist parties and communists.

For example take West Bengal ... it has been under communist rule for many years and yet it prospers and is one of the most prosperous state in India. Now that I think with clear conscience ... Congress, BJP, Communists, Leftists, Centrists are all Indians serving Indians for good of Indians and for betterment of Indians.

I know most of you are going to mek fun to me but its about time that I put my true feelings forward and outward.

I also admire Lallulal. He is one of the greatest politicians. He is misunderstood because he is non-able to express his ideas in English. Is not speaking to know english a crime? No. We must admire a politician for his ideas and not un-ability to speak english.

I am aware most of YOU members here are full of HATE and HATRED but I cannot it ... I am a lover ... its in my nature to be a lover of all things good and wholesome. I hate people who hate other people. For world to be beautiful we must all love and care for each other. Hatred breeds hatred. Love breeds fresh batch of lovers.

Sorry ... I cannot help it but love. Its in my nature. I love loving unlike YOU people who hate for hatred. I forgot to add ... love breeds lovers and hatred breeds more hate and hatred.
