Narendra Modi govt on its knees before Rajnish Rai

AHMEDABAD: The Narendra Modi government on Friday offered an olive branch to deputy inspector general of police Rajnish Rai, who had recently exposed murky details behind fake encounters, by expunging adverse remarks made in his annual confidential report (ACR) by the former director general of police P C Pande.

In a late night communication, received by Rai at around 10.45 pm, the home department informed him in writing that the government had accepted the representation made by him in October 2010 protesting against the downgrading of his ACR. The same representation had earlier been rejected by the government, which had compelled Rai to approach the Central Administrative Tribunal (CAT), before which he filed an explosive affidavit recently implicating the former home minister Amit Shah and several police officials.

The government's surprising move is seen by legal experts as an attempt to put a lid over the case in CAT, which had become an acute embarrassment because Rai had clearly linked the murders of Sohrabuddin and his aide Tulsiram Prajapati, allegedly at the behest of the political leadership and at the hands of police officials from Gujarat, Rajasthan and Andhra Pradesh.

It is not immediately clear if Rai, who is presently on leave for the last six months having enrolled for a course in IIM-Ahmedabad, will accept the peace move. But the government's decision removes obstacles in the path of his future promotions.

It was Rai who had arrested IPS officers D G Vanzara, Rajkumar Pandian and Dinesh M N in April 2007 in the fake encounter of Sohrabuddin. He had also collected the phone call records of these three officers during the period of the encounter, but the government claims to have no knowledge of this. Pande, in an affidavit before the CAT, had accused Rai of insubordination. He clearly stated that Rai had not informed him or his immediate boss, the then additional DGP O P Mathur, of the plan to arrest Vanzara and Co. Rai had given a stinging reply to this, accusing Pande, Mathur and other officials of toeing the political line given by Amit Shah.

He alleged that Shah and his loyal officers were making every effort to cover up the Sohrabuddin fake encounter case and that the Tulsiram murder was also part of this conspiracy because he was a witness to the abduction by the police of Sohrabuddin and his wife Kauserbi. The Supreme Court handed over investigation in the Sohrabuddin fake encounter to CBI in January 2010.

A couple of months back, the Tulsiram encounter was also entrusted to the CBI.
