Ahmedabad: Arrested former Gujarat minister of state for home Amit Shah had entrusted the job of eliminating Sohrabuddin Sheikh to three senior IPS officers, the charge sheet filed by CBI in a court here said.

According to the charge sheet filed in a special court on July 23, "elimination of Sohrabuddin was being used for extortion by the accused persons to establish an element of fear in the minds of the businessmen and others."

The accused persons from Rajasthan police participated in the conspiracy because Sohrabuddin was terrorising the marble lobby in the neighbouring state, the CBI said.

Shah entrusted the job to IPS officers DG Vanzara, Rajkumar Pandiyan and Abhay Chudasama, former DCP of Ahmedabad city crime branch. The BJP leader, who resigned as minister last week, was in constant touch over telephone with Vanzara when Sohrabuddin and his wife were in the custody of Gujarat Police, CBI said.

It said a probe into the role of former Gujarat police officer NK Amin, one of the accused who has turned approver, revealed that he was in constant touch with Shah, on phone.

"He (Amin) made/received as many as 25 calls from/to Shah between November 21, 2005 and November 30, 2005," it said.

The CBI probe further disclosed that in early November 2005, one Tulsiram Prajapati was contacted by accused Abhay Chudasama (former DCP of Ahmedabad city Crime Branch) and produced before Vanzara who asked him to make Sohrabuddin available before him as there was "a lot of political pressure".

Prajapati, killed in a police "encounter" in December 2006, was assured that (his friend) Sohrabuddin would get a safe passage and at the most would be put in jail for 3-4 months. No physical harm would be done to Sohrabuddin, it said.

"Having got the assurance from Vanzara, Prajapati helped Chudasama in tracking Sohrabuddin."

I just don't understand why everyone is trying to paint Amit Shah big villian.

Think, why would a top level minister get involved personally in a murder of a criminal. Same goes for IPS officers when this can be done by any ordinary thulla.

Think...think....Vichaaro bhai lok.

Everything is not like the media is publishing.

Its nothing but big conspiracy.

CBI wants a media trial. As a proof they have a sting operation CD which can not be considered in court. So they are systematically leaking the information to the media to build case against Amit Shah. As per Ram Jethmalani who is representing Amit shah, They have not received Chargsheet from CBI but media is getting detailed chargesheet with other info...

In the first round of the political battle over the Sohrabuddin fake encounter case, the Congress party has surely outsmarted Gujarat Chief Minister Narendra Modi.
But the legal battle and the Central Bureau of Investigation's serious charge that former Gujarat minister of state for home Amit Shah was involved in the case will be challenged in court, says Shah's Bharatiya Janata Party.

After the filing of the CBI chargesheet, Shah's legal case may seem hopeless to many. But in the courtroom, the perceptions circulating in the public realm will not be of any help to the CBI.

It is certain that Shah's case is a highly complex legal matter where the sections of the Indian Penal Code and the Indian Evidence Act of 1872 will be discussed threadbare.

BJP spokesman Devang Nanavati tells Rediff.com's Sheela Bhatt that the Gujarat government does not know the fate of Kausar Bi, Sohrabuddin's wife in the concluding segment of the two-part interview.

Part I of the interview: 'Why is Gujarat being targeted?'

How do you explain the killing of Kausar Bi?

Who says Kausar Bi was killed? She is 'alleged' to have been killed.

It is not proved in a court of law that she has been killed. That is a charge, and that charge has to be proved. We can't have it both ways.

Once the matter is in court, then you should go by the rule of law and the court.

These are allegations and the charges. There is an allegation that Kausar Bi was killed. It has not been established as a matter of fact that she has been killed. The fake encounter case is related only to Sohrabuddin.

Amit Shah took such a long time to appear before the CBI...
Let us decide the timeline. On July 21, the summons was served at the residence of the minister of state at 11 am to appear before the CBI in two hours. Is it a long time?

How would you know ahead of time that the CBI is going to send you a summons?
When we said it is a short time for us, then they said they can give time for the next day.

Amit Shah asked for the copy of a questionnaire. He wanted to consult his party leadership, his government and his lawyers. This is a five-year-old case. He wrote to the CBI that he wants to cooperate. He wanted to verify his ministry's records.

The CBI was so eager and impatient to question Shah that they gave him just two hours notice.

But when he appeared before the CBI, they arrested him within three minutes and produced him before the magistrate in 15 minutes, and for the next two days they didn't even ask him a single question.

Without questioning Amit Shah they prepared the chargesheet of 30,000 pages and it was kept ready before he reached the CBI office.

The exercise was a facade by the CBI. This proves that the CBI's charges against Amit Shah were politically motivated.

Our allegation against the CBI is absolutely correct, that the Congress manipulates it.

Former Deputy Superintendent of Police N K Amin's lawyer has requested the court to allow him to turn an approver. Is it worrying Amit Shah?

Amin has filed an application that will be heard on August 2. We will have to see on what ground he is acting. The Supreme Court has laid out certain guidelines regarding Section 306 of the Code of Criminal Procedure which has a section relating to the turning of an approver.

After so much time that has gone by after the investigations started, if someone wants to be an approver, then the court has to see with great circumspection. Because if an accused wants to go free at the cost of another co-accused, the matter can't be taken lightly.

We have full faith in the court that they would see the point here. I would not like to discuss the merits or demerits of the case.

There was a sting operation recorded inside the jail where arrested police officer D G Vanzara is talking about Shah's involvement in the case with another arrested police officer.

It was allegedly a CBI sting operation where the tape recorder was smuggled inside the Sabarmati jail by another accused.

Again, I have not had the benefit of hearing that recording. One has to verify the audio. One has to see the legal evidentiary value.

The CBI can present anything as evidence. But the court will decide its evidentiary value.

See, hypothetically, even if we say that two co-accused are talking to each other and a third accused is overhearing and secretly recording the conversation, still the conversations of the co-accused cannot become ground for conviction.

Here we are going into the legality of the case. The matter is pending before the court. Let's not discuss them.

Mr Nanavati, you must have gone through the chargesheet.

No. I haven't gone through it. It was given to Shah's lawyer. It will take time to read 30,000 pages. The CBI has given it to the media in advance, and that's what we can see.

Don't you see the game that the chargesheet was given to the media much before the court ordered the CBI to give it to Shah?

Only when Shah's lawyer said that unless you give the chargesheet, Shah would not be able to cooperate in the case was the chargesheet handed over to him.

How is Amit Shah doing?

He should be alright. Amit Shah is a fighter.

Delectably for thriller aficionados, the Sohrabuddin murder mystery is unfurling at several levels. At the primary level, Amit Shah — Narendra Modi’s close aide and Gujarat’s absconding junior Home Minister — has resigned and surrendered to the CBI (Central Bureau of Investigation).

He is charged with murder, kidnapping, criminal conspiracy, extortion, destroying evidence, threatening and influencing witnesses. Besides, it seems that Shah pressured officers to suspend the enquiry, took away enquiry papers apparently for scrutiny, even asked ominously for the list of witnesses whose statements were to be recorded.

Now, two police officers have offered to strengthen the CBI investigation with crucial evidence to nail the minister. Former Gujarat Deputy Superintendent of Police NK Amin, an ‘encounter’ specialist accused in the case who has been sulking in jail since 2007 while his partners in crime roamed free, wants to turn approver. And GC Raiger, former Additional DGP who looked after the CID probe into the Sohrabuddin case before the CBI took over, has become a CBI witness, offering all his insider information.

At level two of this national thriller, the BJP has swung into action to protect Shah, the finest muscleman of Modi, the finest muscleman of the BJP. It doesn’t need more skeletons tumbling out of cupboards, especially about the killing of Muslims in Gujarat. Since offense is the best defense, it has declared war on the Congress-led UPA government.

It refused to go to the Prime Minister’s lunch to plan the agenda for the monsoon session of Parliament and has been screaming ceaselessly about the Congress ‘misusing’ the CBI to target Modi. Shah, they say, is being framed because the Congress wants to stop Narendra Modi from doing his wonderful development work. And to divert attention from the UPA government’s failures — Pakistan, Maoists, Kashmir, inflation.

Unfortunately, CBI enquiries are regularly accused of bias by Opposition parties. Because the Centre routinely uses the CBI as a political tool, like state governments use the police. Of course in the Sohrabuddin case, the CBI enquiry was ordered by the
Supreme Court, but let’s ignore such awkward truths.

At level three are accusations of Shah being a big-time scamster, making crores from the likes of Ketan Parekh. And there’s the cop-criminal-neta nexus with senior IPS officers running extortion rackets. Like they did with Sohrabuddin before double-crossing him for political profit.

At level four is our memory. The same Modi who now talks of Shah’s innocence had in 2007 proudly claimed the murder. What should one do with a baddie like Sohrabuddin, he had asked at a rally. The crowd had screamed, “Kill him!” That’s just what he had done, Modi had beamed smugly, adding: “If I have done anything wrong, let the government of Sonia Gandhi hang me!”

Killing any Muslim and claiming him to be a wannabe Modi assassin — as they did with Sohrabuddin — was part of Modi’s plan to garner sympathy whenever his leadership was questioned. Significantly, Sohrabuddin was killed shortly before the BJP national executive met in December 2005, when Modi was facing dissidence.

Someone could get rich making a computer game out of this multi-level national thriller. But careful when playing it — getting too close to the truth could be lethal.

Not even in his worst nightmares would Gujarat chief minister Narendra Modi have imagined that his protege and minister state for home Amit Shah would go to jail facing charges of criminal conspiracy, twin murder, extortion, abduction and destruction of evidence in the ‘staged’ killing of gangster Sohrabuddin Sheikh and his wife Kauser Bi in November 2005. Shah, who surrendered on July 25 after being chargesheeted by the CBI, has been Modi’s junior home minister since January 2003 after the Gujarat strongman’s landslide victory in the assembly polls after the 2002 riots.

For Modi, Shah was crucial in many respects as he was handling all the important cases related to the 2002 riots apart from managing the home and law departments. He is supposed to be to Modi what Modi is to Advani. “In a way, it’s a big setback for the CM because Amitbhai was indispensable for him. He was seen as Narendra Modi’s shadow,” says a secretary in the government.

The case against Shah began rather innocuously. On November 26, 2005, the Gujarat anti-terrorism squad (ATS), headed by DIG D.G. Vanzara, called a press conference in Gandhinagar to announce the killing of “LeT operative and dreaded terrorist” Sohrabuddin in a police encounter by a joint team of the Gujarat and Rajasthan police. Vanzara, who as the DCP of the Ahmedabad crime branch prior to his ATS posting had already carried out more than a half-a-dozen encounters in which 15 people were killed, claimed the terrorist was on a mission to “kill Gujarat CM Narendra Modi” and was intercepted on Ahmedabad’s outskirts where he was killed in a gunbattle.

Things, however, took a new turn in March 2007 when a probe by the Gujarat police established that Sohrabuddin’s killing was a fake encounter. The police admitted this before the Supreme Court in reply to a petition filed by Sohrabuddin’s brother Rubabuddin. A month later, Vanzara, Rajkumar Pandian of the Gujarat police and M.N. Dinesh of the Rajasthan police were arrested.

However, after more twists and turns, the apex court, which was monitoring the probe from the start, indicted the Gujarat police for botching up the investigation and handed it over to the CBI this January. Six months on, the agency has established that extortion was the main motive for killing Sohrabuddin. His wife Kauser Bi and his accomplice Tulsi Prajapati were killed to eliminate the two key eyewitnesses to the encounter.

The 2,000-page chargesheet filed by the agency before a special CBI court in Ahmedabad on July 23 names 15 persons, including Shah, for serious offences like abduction, criminal conspiracy, murder and extortion. According to the CBI, Shah and his trusted police officials—Vanzara, Pandian and Abhay Chudasama—were running an extortion racket in Ahmedabad and used Sohrabuddin, an underworld operative, to extort money from businessmen and builders. Patel brothers Raman and Dashrath, victims of the racket, in their testimony before a magistrate under section 164 of the CrPC, admissible evidence in court, stated: “We were falsely implicated in a firing case, staged-managed by the police with the blessings of Shah. We were first asked to name Sohrabuddin as the person who executed the firing at our Ahmedabad office and subsequently we were accused of hiring the underworld to settle personal rivalries. To settle the matter, we paid Rs 60 lakh to Vanzara, Rs 40 lakh to Abhay Chudasama and Rs 70 lakh to Amitbhai Shah, on whose behalf his middleman Ajay Patel collected money and delivered it to him.”

The CBI has established that the shooting at the Patel brothers’ office was staged by Chudasama, who sought Sohrabuddin’s help. The latter got the job done through Prajapati and Sylvester.

The ATS also picked up Zahid Kadri, another businessman who knew Sohrabuddin, and subjected him to torture. He was let off only after he paid Rs 40 lakh. Kadri too has given his testimony before a magistrate.

After DCP Chudasama’s arrest this April, the CBI summoned Shah’s associates and middlemen Ajay Patel and Yashpal Chudasama, chairman and director of the Ahmedabad District Cooperative Bank. In their video-recorded statement to the CBI, both have admitted to their role in extortion, bribing and threatening certain witnesses in the case. Patel also admitted that he received Rs 70 lakh in three instalments on Shah’s behalf and had the money delivered to Shah.

To make the case against Shah and his trusted cops watertight, the CBI has adopted the following strategy:

It has allowed one of the accused cops, SP N.K. Amin, to turn approver, which will help in establishing the murder of Kauser Bi. She was murdered at a farmhouse outside Ahmedabad and her body burnt later at Illol village in north Gujarat. Vanzara hails from this village.


It also wants former IPS officer G.C. Raiger and serving IPS officer Geetha Johri to be witnesses. Both dealt with the investigation when the probe was with the Gujarat police. Raiger was additional DG, CID (crime), and was transferred overnight when he refused to help in the investigation. According to the CBI, Shah put pressure on Raiger and Johri, who headed the SIT probing the Sohrabuddin encounter, to weaken the case, destroy evidence and slow the pace of the investigation. “We have asked Raiger and Geetha Johri to cooperate with the process of investigation or face the music,” says a CBI official. “Once they testify for prosecution, it will help in establishing that Shah had tried to hamper the investigations and destroyed evidence.”
With the noose around his neck tightening and the CBI questioning him at length, more skeletons are likely to tumble out of Shah’s closet. Whether Shah reveals any links with Modi to imply the CM was in the know of the extortion racket he and some top cops were running is a moot point. But it’s already stirred a political hornet’s nest.

The thing is, actually it is the Congress which is in damage control mode. To divert the attention of the nation from Kashmir problem, inflation, CWG scams etc.. They are trying to turn the tables on the opposition and break the unprecedented unity. Does anyone remember the Left agreeing with BJP on anything ever??

CBI told the Gujarat high court on Friday that it had evidence indicating former minister of state for home Amit Shah’s involvement in the killing of Tulsi Prajapati as well.

Shah is already facing charges of killing Sohrabuddin Sheikh and wife Kausarbi in fake encounters.

CBI also said documents pertaining to the communication in state CID about the interrogation of Prajapati had gone missing.

According to CBI, Prajapati was witness to the abduction of Sohrabuddin and Kausarbi and was killed in a staged encounter. KTS Tulsi, the counsel for CBI, argued, “There is evidence to the effect that Prajapati and Kausarbi were killed on the instructions of the minister [Shah] as they were witness to the event of kidnapping and killing of Sohrabuddin.”

Meanwhile, Gujarat high court on Friday granted CBI two days’ custody of Shah. The minister, who was arrested on July 25 in the Soharabuddin fake encounter case, is close to Gujarat chief minister Narendra Modi. Though CBI had sought a10-day remand, justice Akil Qureshi granted only two days. The court also rejected the plea for videographing his questioning.

When we were in judicial custody (after firing at the office) we came to know from different sources that the firing was stagemanaged at the instance of Abhay Chudasama and D G Vanzara. After Sohrabuddin’s encounter on 6.12.2005 ATS police forcibly picked me and my brother and took us to the ATS office. There Rajkumar Pandian and Vanzara threatened us to give statement against Sohrabuddin, (Tulsiram) Prajapati and others. They also threatened us that if we don’t act as per their diktat they will implicate us in false case. They let us go, then again on 15.12.2005 we were called to ATS office. A phone call came on Vanzara’s cell and he was talking respectfully. After some time he put me through the phone and Amit Shah, minister of home, was on line. I recognised the voice and Amit Shah forcefully directed me that I should give my statement to Vanzara or else I will be in trouble. I insisted that I will speak the truth. Vanzara arrested me and brother in the case related to firing on my office. Vanzara later told me that if I don’t want to be killed like Sohrabuddin I should pay Rs one crore. I was scared, Vanzara and Pandian agreed to accept Rs 60 lakh. Accordingly the money was arranged when we were in police custody to Vanzara in Pandian’s presence. Later Pandian threatened third degree methods if we did not pay him Rs 15 lakh separately. ...We were implicated in seven false criminal cases during the period from 2001 to 2005. In 2006, we learnt that Amit Shah is planning to book me and my brother under PASA, since the marriage of my niece was scheduled we were worried. I came in touch with Ajay Patel who is the president of Ahmedabad District Co-operative Bank. Ajay Patel told us that Amit Shah had demanded money to settle the whole issue and had demanded Rs 1.5 crore. Keeping in view the marriage of my niece, on 16.05.2006 we paid Rs 25 lakh, thereafter Rs 25 lakh on 20.06.2006 and Rs 20 lakh on 31.05.2006. I had not paid Rs 20 lakh because the cases against us were not closed. Once when I and my brother were meeting Amit Shah at his Ahmedabad residence (we asked)... why was Sohrabuddin killed when he was working closely with Abhay Chudasama. He smiled and said Sohrabuddin had himself closed the option of keeping himself alive and that political equations and needs we would not be able to understand. It became clear to me Sohrabuddin was killed for political and not financial gain. I do not remember meeting Amit Shah after Tulsiram was killed. We were contacted again after a very long time by Ajay Patel on behalf of Amit Shah. He told us that Amit Shah had sent a message with CBI officials likely to contact us, and we should give a statement that in no way harms anybody..... On 3.3.2010 Ajay Patel called my brother Dashrath arranging a meeting with Abhay Chudasama.... Chudasama told us that they will give in writing the statements we should give to CBI officials.

Sohrabuddin was extorting money from the traders and businessmen of Rajasthan and Gujarat at the behest of suspended IPS officer of Gujarat-cadre, Abhay Chudasama. Chudasama and Sheikh were sharing the booty at the proportion of 75 per cent and 25 per cent respectively. Chudasama sent me to Madhya Pradesh to meet family of Sheikh to wind up the legal proceedings initiated by them against Gujarat Police in the fake encounter of Sohrabuddin. He allegedly offered Rs 50 lakh. When family members of Sheikh refused... Chudasama had told me that ‘Sohrab’ was his ‘good friend’ and that he had saved him from trouble in the Haren Pandya assassination case.

After Sohrabuddin’s encounter, the ATS personnel picked me and my son from my house in village. Pandian...beat me up in the office. Vanzara and Pandian threatened me and abused me. They recorded my statement which I had never given.... Vanzara, Chudasama and Pandiyan used to threaten to kill me as they had encountered Sohrabuddin.

My letter through which I had sought permission from Ms. Geeta Johri, and on which she had endorsed that she may be also allowed to accompany me to visit Udaipur to examine Prajapati is not available in the correspondence file which was maintained in the O/o ADGP, CID (Crime). In my Interim Report 5, I had written to the effect that permission is yet to be granted for visiting Udaipur for investigation for obtaining the information about Prajapati and Sylvester, at Central Jail in Udaipur.

In the note sheet of the file of PE 66/06 of the O/o the ADGP, CID (Crime), Ms. Geetha Johri had sought permission to visit Udaipur for examining Sylvester and Tulsiram on 05/01/2007. But firstly, it makes no sense asking for permission to examine Tulsiram after he was already killed on 28/12/2006. Secondly, I find that there is no material (my report is not there in this file, and even on the note sheet there is no previous mention of Sylvester or Tulsiram anywhere) to seek such a permission. Therefore.... I state that my report and the original note have been destroyed. This must have happened after Tulsiram was killed. Had my report and the comments of Ms. Geeta Johri on that report remained on file along with the note of Ms. Johri seeking permission of Shri Raigar, it would have been clear that the permission was withheld by Shri Raigar and in the intervening period, Tulsiram was killed.... My report and the original note seeking permission must have been destroyed. Ms. Johri should definitely know it. It was strange conduct of Shri Raigar to have granted permission on the note dated 05/01/2007 for examining Tulsiram, who was already dead. In any case, this permission was never communicated to me. In view of all these, I can say that the note dated 05/01/2007 was fabricated after the death of Tulsiram. Why Shri

Raigar would have withheld the permission asked for, for more than two weeks, I do not know. But as I said before, about what Ms. Geetha Johri had conveyed to me twice... anybody can understand that Shri Raigar would have acted under pressure from Shri Amit Shah and P. C. Pande.

In 2002, after the Godhra incident, there were riots all over the state. There were no riots in our area. This was not tolerated by certain elements. Resultantly, on 07.05.2002, ... at around 9.00 o'clock local police officers came... fired 147 rounds and also fired 97 teargas shells. Some of the boys out of fear climbed on the terrace of Moin Apartments. These boys were stripped naked and shot dead from point blank range. One of these boys was my son, Farhan @ Raju. In this regard, I made complaints at various quarters and also filed complaint case in Metropolitan Magistrate’s Court No. 15 .... However, so far nothing has been done in this enquiry.... In this regard, I had also filed writ petition in the Gujarat High Court on 19.05.2005.

I know Sohrabuddin since 1997 as he was my neighbour.... I did not have any close association with him.... I was picked up by Shri Dabhi of Anti Terrorist Squad from my house at 4.30 am on 6.12.2005. Shri Dabhi, Shri Chauhan, Shri Parmar and 20-25 others rushed into my house. I know Shri Dabhi as (we) played together during university days.... I asked them why was I being arrested when I had done no crime. They said Amitbhai has asked us to arrest you. They handcuffed me and took me to the ATS office.... I saw my brother-in-law Shri Imtiaz Kadri, Noor Goghari and Murtaza Khan Pathan, leader of Youth Congress were sitting there. They took me to the ‘Jallad’ who was none else but SP Rajkumar Pandian. Pandian told me that you have to do two things : one, withdraw the petition against the police filed in connection with the death of my son Farhan@Raju and second give a statement against Sohrabuddin, Jhalla, Goghari and others falsely implicating them in the incident of firing at the (Popular Builders’) office.... If you don’t do this I have the permission to do encounter, as directed by Amitbhai. I did not agree. Then Shri Pandian told Shri Choubey to gave me electric shocks. Shri Dabhi also punched me.... It was illegal confinement till 12.12.2005.... On 16.12.2005, I was called by Shri Dabhi...and was asked to come to ATS. They gave me a statement prepared by them and told me that you have to give the same statement in the court. I told them it is wrong but they threatened to kill me. On 12.01.2006, I was forcefully taken to the Hon’ble Metropolitan Magistrate Court No. 10 and made to give a statement. Shri R.B. Joshi, PI and Shri D.R. Goswami, PI compelled me to make that bogus statement (in court).

... I was picked up by Shri M.L. Parmar, Dy. S.P. from my residence after the false encounter of Sohrabuddin, from my house at 2.00 am.... In the ATS office Shri D.G. Vanzara and Shri R.K. Pandian told me that I was arrested because of directions from Shri Amit Shah, MoS (Home). Shri Vanzara and Pandian were threatening me of dire consequences and wanted me to falsely depose against Manilal Ghosar, Sohrabuddin, Jhalla, Goghari and others.... I kept on telling them not to make me depose falsely. I kept on pleading with them... but to no avail....

Rajeev Dasot IGP of Udaipur, Rajasthan, when Sohrabuddin was killed

No information was available to me or brought into notice of mine about the activities of Sohrabuddin or Tulsi Prajapati. Before going to Ahmedabad, the then SP Mr Dinesh M. N. told me that one fellow Sohrabuddin was a notorious criminal and wanted in a murder case and he wanted to go to Ahmedabad for his arrest, just before leaving for Ahmedabad. I found it a bit out of place and I asked him whether for a murder accused going of a SP is necessary? ... He said, “Sir he is a notorious criminal and wanted in one Hamid Lala murder case and that he was already in touch with Gujarat Police for this information”.

Sylvester Daniel Sohrabuddin’s aide, Udaipur resident, currently in jail

Some time in late 2004, Sohrabuddin told Tulsi and me to go and resort to firing in the office of Raman Patel and Dashrath Patel, M/s Pioneer Infrastructure, Navrangpura. Sohrabuddin said that he has been instructed by Abhay Chudasama to get this firing done. He further instructed that no one should be injured and only a terror has to be created.... Meanwhile Tulsi fired on a computer and two shots in air and both of us left from the office of Patel brothers.... After arrest of Tulsi and me by Rajasthan police in Hamid Lala murder case when we both were lodged in Udaipur Central Jail, during that time Tulsi informed me in one conversation that in the middle of November 2005 he was called by Abhay Chudasama, who told him that there was pressure from politicians to apprehend Sohrabuddin. Chudasama had further told Tulsi that Sohrabuddin will only be arrested and no physical harm will be done to him. Accordingly Tulsi met Sohrabuddin and went with him from Indore to Hyderabad....They (Gujarat police) forcibly deboarded Sohrabuddin, (his wife) Kausar Bi and Tulsi. While police personnel deboarded Sohrabuddin, Kausar Bi came forward and opposed.... Then Pandian directed (his men) to take Kausar Bi. Tulsi also informed that he was brought straight to Udaipur and after 4-5 days his arrest was shown from Bhilwara by Rajasthan police in Hamid Lala murder case. Tulsi also told that he was under constant fear that police will eliminate him... (as) he was eyewitness of abduction of Sohrabuddin and his wife Kausar Bi.

Kuldip Sharma who was head of CID once has been booked for murder in 1984 encounter case Prabodh Raval of Congress was home minister at that time. So, when Congress is taking extra pain to paint Gujarat BJP as a villain this might be seen as a revenge...Your HM Vs My HM. Next few days are going to be interesting for Gujarat Politics..

The Truth about Sohrabuddin Sheikh


Rather expectedly, and unfortunately, the debate on the killing of Sohrabuddin Sheikh by a team of police officers from Gujarat, Madhya Pradesh and Andhra Pradesh has got compressed into a quarrel on Narendra Modi. There are those who see this as comeuppance for the Gujarat chief minister, among India's most charismatic as well as most polarising politicians. There are others who see this as vendetta on the part of the Central Bureau of Investigation (CBI) and the UPA government.

It would be unfair to reduce the episode to a referendum on Narendra Modi. Things are far more complex. Some internal security specialists and policing veterans - not all them Modi fans - are plain distraught. They believe the politicisation of standard crime fighting and the implication of sections of the police in a tussle between India's two biggest political parties will prove hazardous in the long run.

To understand why, one needs to answer four key questions:

  1. Who was Sohrabuddin Sheikh?
  2. Has his killing become emblematic of a moral crusade against fake encounters?
  3. What are the CBI and the Congress accusing BJP politicians in Gujarat and Rajasthan of?
  4. Either way, whether you like Modi or love the Congress, why are disturbing questions emerging?

Sohrabuddin's background needs to be placed in context. In the late 1980s, Abdul Latif was the underworld king of Gujarat. Based in Ahmedabad, politically well networked, he made a fortune in the bootlegging industry. Later, he became Dawood Ibrahim's business manager in the state and was one of the criminal dons to make a transition from organised crime to terrorism. Latif was a suspect in the Mumbai bombings case of 1993; the RDX for that operation landed, remember, on the Gujarat coast.

In November 1997, Latif was killed in an encounter by the Ahmedabad police. He was under arrest and had allegedly tried to escape while using the toilet. A Congress-backed Rashtriya Janata Party government was then running Gujarat. The chief minister was Dilip Parikh but the power behind the throne was Shankarsinh Vaghela, who later became minister for textiles in Manmohan Singh's first government (2004-09).

Whatever the Congress may say now, in 1997 Vaghela's supporters saw the elimination of Latif as an achievement and a sample of their leader's courage and resolve. The importance of Latif's departure from the state terror matrix was enough for that redoubtable magazine, Frontline, to recall it in its April 29-May 12, 2000, issue.

"Shortly after massive blasts occurred in New Delhi's Lajpat Nagar market on May 21, 1996," the article in Frontline said, "RAW made available intercepts that led the Srinagar Special Operations Group (SOG) of the Jammu and Kashmir Police to Jammu and Kashmir Islamic Front (JKIF) operative Farida Wani. Soon after, her boss, Hilal Baig, was shot dead by the SOG on July 17, 1996. Telephone intercepts also led the Gujarat police to one of the JKIF's top associates, Ahmedabad underworld baron and Dawood Ibrahim associate Abdul Rashid Latif. Latif was arrested from New Delhi by a Gujarat Police Anti-Terrorist Squad on October 10, 1996, and was killed later while attempting to escape from custody in Ahmedabad."

Many of Latif's cohorts were put under watch. One of them was his driver, apparently responsible for, in one daring move, hiding a huge cache of weapons meant for terrorist groups. This was part of the consignment that had arrived before the Mumbai bombings of 1993. Latif was under surveillance and so his driver had stored the arms in a well in his (the driver's) native village near Ujjain, Madhya Pradesh.Â

The driver eventually faced over 50 cases, including some under the National Security Act. He was arrested, separately, by the Gujarat and the Madhya Pradesh police forces, but avoided conviction. When not facilitating terror networks, he was engaged in extortion rackets in Rajasthan, acting almost certainly on behalf of others. His principals, the police suspected, were linked to terror funding.

The name of Latif's driver was Sohrabuddin Shaikh. Strictly speaking, there is no definitive evidence that he was an Islamist terrorist. His theological conversion to global jihad - in the manner of, say, a Hafeez Saeed or a Masood Azhar - is unproven and perhaps even unlikely. Sohrabuddin's day job was extortion. Many of his accomplices were Hindu and many of his victims were Muslim. Additionally, however, he was active at the periphery of terrorism: playing courier for jihadist networks, delivering weapons and cash.

In November 2005, Sohrabuddin was killed in an operation involving the police forces of Rajasthan, Andhra Pradesh and Gujarat. Representatives of the Intelligence Bureau (IB), a federal agency, were also said to have been present. The IB had in its possession wire taps that established Sohrabuddin talking to Dawood Ibrahim and agreeing to take delivery of an arms consignment in Kerala.

It is probable Sohrabuddin was killed in cold blood and that witnesses to his death, including his mistress and an associate, were similarly silenced. This takes us to the larger issue of the "philosophy", if that be the word, behind fake encounters.Â

Fake encounters were used in West Bengal to quell the Naxalite insurgency of the 1970s. In the 1980s and early 1990s, when the lower judiciary in Punjab was overwhelmed by threats and wary of convicting Khalistani extremists, K.P.S. Gill's police force was also said to have resorted to such killings. In the 1990s too, "encounter specialists" in the Mumbai police crippled the city's criminal gangs.

More recently, the popular mood in favour of encounters was driven by the shame of Kandahar, when three terrorists had to be released to win freedom for the hijacked passengers of flight IC-814, on the final day of 1999. After that, police and paramilitary forces in Jammu and Kashmir and elsewhere began to operate on a silent "take no prisoners" approach, especially when it came to high profile targets.

Admittedly, all the above examples have had their disquieting offshoots. A Congress government of the early 1970s defeated Naxalism in West Bengal but created such a fear psychosis that the party was voted out of office in 1977 and has never returned to power. In Punjab, the police became a law unto itself, one that successive peacetime governments have had to grapple with. In Mumbai and Delhi, police officers seen as "daredevils" and "encounter specialists" began taking sides in gang warfare, aiming their guns at some criminals more than others, and supervising dubious land deals.

Perhaps it is no different in Gujarat or Rajasthan or Andhra Pradesh. Perhaps individual police officers who began with good intentions have allowed their initial success and public adulation to go to their heads and turned rogue.

Even so, it difficult to believe that fake encounters can be entirely avoided. Their numbers should not be exaggerated but neither should chances of their abolition - not until the Indian criminal justice system becomes efficient, delivers quick judgements and the standard for conviction, particularly in cases of terrorism, attempted terrorism or conspiracy to execute a terror strike, is made realistic and contemporaneous with anti-terror legislation in other democracies.

A few weeks ago the Wikileaks revelations drew attention to a United States Special Forces unit called Task Force 373. Its mandate is to hunt down and kill "high value" terrorists and Taliban leaders in Afghanistan, without presenting them for trial. That the Americans do it doesn't make fake encounters legal; it just points to the broader sanction that such methods have.

Contrary to some of the media commentary, the Sohrabuddin chapter has not become a barometer for the acceptability or otherwise of fake encounters. The Congress and the UPA government are not promising to lead a campaign against fake encounters, to reform the Indian justice system and make such occurrences unnecessary in the first place. That is not the nub of the CBI's case either.Â

Rather it is being made out that Sohrabuddin was killed not because he was a criminal but because he was the front man for an extortion enterprise that was masterminded by BJP ministers in Gujarat and Rajasthan (ruled by the BJP till December 2008). It is being contended he extracted money from businessmen and shared his loot with a succession of police officers and, perhaps, the home ministers of both Rajasthan and Gujarat. It is being suggested that in Gujarat the chain of command went beyond the former home minister, Amit Shah, to his boss.Â

Legal specialists who have studied the CBI's charge sheet and senior police officers who have spoken to members of the investigation team are perturbed. There is "zero evidence", to quote a usually unimpeachable source, to link any politician, or even most of the police officers who have been arrested in Gujarat, to any extortion matrix. Neither is the role of the Andhra Pradesh government - the state is ruled now, as it was in 2005, by the Congress - being adequately explained. The IB's dossier on Sohrabbudin has disappeared. Suddenly, he is a small-time crook who was used and dumped by sinister people in the BJP, no more.

What is the upshot of all this? First, even if Amit Shah, the Modi government in Gujarat and the previous BJP government in Rajasthan (not to speak of the Andhra Pradesh government that lent support to the anti-Sohrabuddin mission) are found to have acted in good faith and are honourably exonerated by the Supreme Court at a later date, even if the CBI charge sheet is ultimately debunked, the damage to Narendra Modi has been done.Â

Modi has an enviable record as chief minister. In his years in office, Gujarat has become a robust manufacturing economy; it has shown agricultural growth when farms in the rest of India have been despondent; it has put together social sector schemes (such as the Chiranjeevi Yojana, which has checked maternal mortality) that have won international awards.

Nevertheless the 2002 violence still haunts Modi. It makes him a hot potato for potential BJP allies elsewhere in the country. This is a political setback for him. Legally, however, there is no case against him. To quote an American diplomat, "At best, his administration can be accused of acts of omission, not commission."Â

What has the Sohrabuddin affair done? Even before Modi has completely overcome the burden of 2002, it has trapped him in another marsh - accused of using and killing a minor criminal, who happened to be Muslim, and presiding over a robber-baron state government. This is the Congress' best-case scenario. It is the public perception it would want created.

Modi's battles are for him to fight. There is a second consequence that needs to be seen through a disinterested prism. The Congress, the CBI and Modi's many critics in the media have completely ignored Sohrabuddin's serious criminal history. It is nobody's argument that an individual's religious identity alone is enough to paint him guilty. Equally, it should be nobody's argument that an individual's religious identity alone should be enough to whitewash his record and paint him as an innocent victim.

These are sensitive times and India, like other societies, needs to make every effort to sequester the pursuit of criminal justice from denominational prejudice, rhetoric and instigation. In giving Sohrabuddin the halo of "martyrdom", the Congress, a party in power in New Delhi and in several states, a party the governments of which will need to take on criminals and terrorists of various religious colours at some stage or the other, is playing a high-risk game. Today's goal could as easily be tomorrow's self-goal.
