GANDHINAGAR: Gujarat governor Dr Kamla took the Narendra Modi government by surprise on Friday by appointing a close Anna Hazare aide and former justice of the Gujarat High Court, R A Mehta, as the new Lokayukta. Justice Mehta had hosted Hazare at his residence during his last visit to Ahmedabad in the month of May and he has been closely associated with civil society in Gujarat.

The governor's order, based on the recommendation of the chief justice of Gujarat HC, came just after midnight and within a couple of hours of her talks with three senior state ministers who came to Raj Bhavan with a selection criteria that she outrightly ridiculed and rejected. While the Modi government knew she would act soon in the matter, few believed she would bypass the government and appoint a Lokayukta herself .

The governor took the action under Section 3 of the Gujarat Lokayukta Act, 1986, which gives her the right to appoint Lokayukta without consulting the government. She based her decision on legal opinion given by the Attorney General of India, while avoiding talking to the Advocate General of Gujarat. She was advised that not appointing a Lokayukta for more than seven years was irrational and that it was a matter of grave concern that there was no authority to probe affairs of the government .

On Thursday night, Modi had sent a proposal to her that a committee consisting of three ministers, the leader of opposition and chief justice should suggest a panel of three judges and one of them be selected on the basis of a majority vote. The governor found this ridiculous and told this to the three ministers - Vajubhai Vala, Jay Narayan Vyas and Saurabh Patel - who met her with this suggestion.

Early on Friday morning, the governor was expected to meet Congress MLAs, led by the leader of opposition Shaktisinh Gohil, on the same issue. But when Gohil and Co. arrived at the Raj Bhavan, the governor informed them that the appointment had already been done and that they should now cooperate with the new Lokayukta.

Pro-poor judge with a heart

Justice R A Mehta (74) came into limelight as a young advocate when he assisted Justice B K Mehta commission which probed the Machhu dam disaster in Morbi in 1976. He was appointed judge of Gujarat High Court in 1984 after about 10 years of legal practice. He remained a judge of Gujarat HC for 14 years during which he gave some very significant judgments. These included abolition of carrying of night soil on head by scavengers and regularisation of street hawkers in Ahmedabad. In the Golana massacre case, the worst incident of caste violence in Gujarat, he gave guidelines for the government and police to follow in case of caste and communal tensions.

The then CJ of the Supreme Court, A M Ahmedi, had offered him the position of CJ of any HC in India. He politely declined a promotion transfer because he wanted to stay in Ahmedabad to take care of his ailing mother. He was the one who modernised the Gujarat HC and encouraged widespread computerisation before he retired in 1998. He served as chairman of Gujarat State Judicial Academy after his retirement from the HC. When he conducted a public hearing into the Surat floods in 2006, he gave a report indicting the then irrigation minister Narottam Patel for this man-made crisis. This is perhaps one of the reasons why the present government is not in his favour.

Among his hobbies are birdwatching , wild life and astronomy.

AHMEDABAD: After Tata steered Nano's manufacturing facility to Sanand, another automobile giant is preparing to pull in to Ahmedabad district. Carmakers' interest in the area has driven real estate firms to target comparatively cheap land in rural areas that are fast developing into residential zones.

The two factors, however, have set off an avalanche of land frauds. The number of complaints at the Ahmedabad collectorate related to various kinds of land frauds and scams has touched 600.

While every district's police force has been asked to look into land scams, the unprecedented number of complaints forced the district police to set up a special investigation team (SIT) to deal exclusively with such disputes. The SIT is headed by an officer of the deputy superintendent of police (DSP) level.

According to SIT officials , land under dispute is worth no less than Rs 300 crore. While 45 complaints have been converted into FIRs by police, others are still being probed. "All grievances are being crosschecked before being considered formal complaints ," a SIT official said. "Some cases involve political leaders and industrialists ."

M M Malek, DSP, the incharge of SIT, said: "We received 10 to 15 complaints every day soon after the SIT was formed."

He said the number was quite high for any investigating agency. He said the flow had reduced somewhat over the past three months. "Now we get 10 to 15 complaints every month," he said, attributing the complaints to the rise in awareness among buyers and sellers. Malek said that most cases have been reported from fast developing areas such as Sanand, Bopal , Kanbha, Viramgam and Sarkhej.

"Because of the realty boom, people turned rich overnight in the areas surrounding Ahmedabad city," he said. "The boom has spawned opportunists who can sell land to the needy with forged papers or fake power of attorney. In some cases, owners are coerced into selling land." Officials said that there was hardly any village on Sanand-Nal Sarovar road that did not report a land scam. They said offences were of three types: execution of sales deed with false power of attorney; duplication of sales; selling with forged sales deed.

Earlier this year, Gujarat Congress had submitted to the Governor Dr Kamla and the president a detailed list of '17 scams' that had allegedly taken place under the Modi government. It demanded probe by an independent agency. Last week, when it was getting apparent that a Lok Ayukta for the state was close, the state government set up an enquiry commission to be headed by retired Justice MB Shah. The following is the list of alleged scams submitted by the Congress to the Gujarat governor and the president:

Land for Nano plant at low rate
The state government allotted 1100 acres of land to Tata Motors Ltd (TML) to set up the Nano plant near Sanand. The land was allotted allegedly at Rs900 per square metre while its market rate was around Rs10,000 per square metre. Simply put, the government gave Tata Motors total monetary benefit of Rs33,000 crore.

Land sold cheap to Adani Group

Land was allotted to Adani Group for the Mundra Port & Mundra Special Economic Zone (SEZ) at Re1 per square metre. This is grossly lower than the market rate.

Cheap land for ind, not for airforce

The Gujarat government allotted 3,76,561 square metre of land to real estate developer K Raheja at Rs470 per square metre, while the South-West Air Command (SWAC) was asked to pay Rs1100 per square metre for 4,04,700 square metre land.

Agricultuure University land allotted for hotel

State government allotted 65,000 square metres of land belonging to Navsari Agriculture University in Surat to Chatrala Indian Hotel Group for a hotel project despite objection from the institute. This deal was allegedly brokered by the chief minister through his office causing a loss of Rs426 crore.

Border land for chemical firms
A huge plot of land near the Pakistan border was allotted to salt chemical companies said to be close to BJP leader Venkaiah Naidu.

Essar Group's encroachment
State government has allotted 2.08 lakh square metres of land to Essar Steel. Part of the disputed land is CRZ and forest land that cannot be allotted as per Supreme Court guidelines.

Land given to Bharat Hotel
Prime land was allotted to Bharat Hotels without auction on Sarkhej-Gandhinagar Highway in Ahmedabad. The company has been allotted 25,724 square metre land.

Corruption in allotment of lakes

State government, in 2008, awarded contracts for fishing activities in 38 lakes without inviting any tenders; bidders were ready to pay Rs25 lakh per lake.

Land given to L&T

Larson & Toubro (L&T) was allotted 80 hectare land at Hazira at the rate of Re1 per square metre.

L&T has been in Hazira for more than 20 years that I know of. When is this incident dated ??


Land allotted to other industries

Instead of auctioning prime land in the major cities of the state, the Gujarat government had allotted the land to some industries and industrialists who had signed MoUs in the five editions of VGGIS.

Cattle feed fraud

The Gujarat government had purchased cattle feed from a blacklisted company at Rs240 per 5 kg whereas the market rate is just Rs120 to Rs140 per 5 kg.

Scam in Anganwadi centres

Two bidders apparently formed a cartel and bid for supplying supplementary Nutrition Extruded Fortified Blended Food (EFBF) to Anganwadi centres of the state. One company bid for three zones, while the other for only two. Guidelines were violated, causing the state exchequer a loss of Rs92 crore.

GSPC

Despite an investment of Rs4933.50 crore, GSPC has been able to earn only Rs290 crore from the 13 out of 51 blocks of oil and gas discovered by the company. Contractual relations of Geo-Global and GSPC deserve investigation since Geo-Global is to be hired for a higher fee, above profit-sharing.

Luxury aircraft used by CM

Instead of using commercial flights or state-owned aircraft and helicopter, chief minister Narendra Modi had used private luxury aircraft for around 200 trips in five years. The cost had been borne by the beneficiary industries.

Rs500 crore SSY scam

The Rs6237.33 crore Sujalam Sufalam Yojana (SSY) announced in 2003 was to be completed by 2005 but it is still not completed. Public accounts committee of Gujarat assembly unanimously prepared a report indicating a scam of overRs500 crore which was not tabled.

Indigold Refinery land scam

Around 36.25 acre farmland in Kutch district was purchased and sold in violation of all norms by Indigold Refinery Ltd.

Swan Energy

49% of the shares of Pipavav Power Station of GSPC were sold to Swan Energy without inviting any tenders.

Oh what fun to see that smug Modi being dragged to court by the Lokpal

I am now totally against Anna Hazare because he is a cheap blackmailer. And however it is and whatever it is, our form of democracy works while other nations which were once ours - Pakistan and Bangladesh - have failed.

And here comes this tyrant to scew it all up. I dont look at immediate results but long term side effects and I can see our democracy and parliament being undermined. There will be hubris as no one would want to take any decisions for fear of Lokpal second guessing every move.

Dont read my writings now, dont listen to me now, berate me now, but wait another 5 years and come back to this topic again and note down the side effects then.

I thought the land was sold to Adani in the 90s. I had made a trip when the port was being built. and even in those days they had the land to develop a commerical area

That areas was nothing before Adanis started the project. So 1 Re / Sqyd should have been the right price then.

Somewhat like Bombay was worth 1 lakh when given as a dowry to the english by portugese.

few points

1. congress should have approch to the bjp for how to kill anna's movement at the begining because bjp need more weaker law for anti corruption
2. if this movement raised in bjp era, would never been succeed because the mobs with anna now, would have part of bjp
3. the main point is that congress dont want violation in the country therefore avoided any fotce action against the traitor team anna

4. the bitch bedi is disgusting, yesterday appreciate delhi police chief for cooporation, if force used by police, cong govt would have been blamed... Bitch lost respect of mine.
