Post Mandir case not over yet! Wakf board files case in Supreme Court

Those who were jumping with joy that its a victory for Ram Mandir, for Hindutva, would now realise that their joy was shortlived. It was expected.

The Uttar Pradesh Sunni Central Waqf Board (SCWB) on Tuesday announced to move the Supreme Court against the High Court verdict in Babri Masjid-Ramjanma Bhoomi case. Even though the board has decided to challenge the judgment, it has kept the doors open for talks with rival


Addressing press conference in Lucknow the chairman Zufar Ahmad Farooqui said the 13-member board had taken a unanimous decision on the issue.

But Farooqui made it clear that the board had not authorized any body or any organization to initiate talks with other parties for out-of-court compromise.

Farooqui said “if any proposal of out-of-court compromise is made by any party of the suit, the same will be considered by the chairman and appropriate decision shall be taken after consultation with the board”.

The Waqf board was main Muslim party in the litigation and while trifurcating 1500 sq yards land at the disputed site in Ayodhya, the High Court had allotted one-third to it in its verdict on September 30.

During the last few days, Farooqui said, a lot was confusion was prevailing over the out-of-court settlement. He said the board never authorized one of the litigants - Mohd Hashim - to hold talks with other parties on the issue. He said in case of any compromise formula any future only Waqf Board would take it up.

Mohd Hashim has been holding discussions with Akhara Parishad in Ayodhya for an amicable solution. However with today’s decision the board has tried to put a brake on such exercise.

Even Naib Imam Eidgah and member All India Muslim Personal Law Board (AIMPLB) Maulana Khalid Rashid Firangi Mahli had also been laying stress on settlement before moving the apex court. On Waqf board’s decision Rashid said even after going to apex court, the doors of out-of-court compromise would not be closed.

In fact Khalid Rashid had been reflecting general feelings of Muslim community. But the dominant group in AIMPLB appears to be in favour of moving the apex court. The AIMPLB spokesman Qasim Rasool Ilyas said the board was open to compromise formula with the ambit of “Shariah and the Constitution”.

AIMPLB general secretary Maulana Nizamuddin told HT that all the issues connected with the verdict would be discussed on October 16.

Ilyas said that AIMPLB working committee meeting on October 16 in Lucknow would discuss the possibility of the board becoming a party in litigation in apex court.

The AIMPLB was so far not party in title suit. In the past the board had intervened several times in the Supreme Court in the matter.

Prior to this AIMPLB legal committee is meeting in Delhi on October 9 to discuss the verdict and make suggestions to the working committee.

In matters related to Masjids, the Waqf board has to take action and be seen doing its work - taking care of the mosques. After its summary dismissal in the HC, they are going to have to prove their locus standi in the matter.

Advani's work finally bears its fruits.

Ayodhya verdict vindicates my rath yatra: Advani

Senior Bharatiya Janata Party leader L K Advani felt 'vindicated' about his Ayodhya 'rath yatra' in the wake of the Allahabad high court verdict and preferred a negotiated settlement for building a Ram temple at the place where the makeshift now stands.

Advani, the mascot of the temple campaign who launched the rath yatra in 1989, also rejected criticism that the last week's judgment of the Lucknow bench puts faith above law, saying it is only a case of 'faith upheld by law.'

He strongly endorsed his party president Nitin Gadkari's suggestion that Muslims can build a mosque 'outside the complex' in Faizabad on the banks of river Saryu.

In the course of more than an hour-long interview with PTI, the BJP leader, who will turn 84 next month, was careful in his statements and did not want to appear victorious after the judgment and did not said anything that would ruffle the feathers in the Muslim community.
