Supreme Court of India Comes Down On Bloggers

"The Indian Supreme Court has ruled that bloggers cannot shelter under an escape clause such as 'Any views expressed are solely those of the writers' to exercise freedom of speech in discussions and statements online. The ruling comes in response to an anti-defamation case filed against a 19 year old student's Orkut community, commenting upon the right-wing political organization Shiv Sena. This organization is based in the western state of Maharashtra and has been responsible for inflammatory speeches and numerous attacks upon non-Maharashtrians."

The article does not make it entirely clear whether the student owner is himself accused of defamatory speech, or only commenters posting on his site. His defense that an Orkut community is not equivalent to a public forum was denied.

This is just ridiculous! Hopefully someone will appeal this on this verdict saying it goes against basic tenets of constitution in which case I believe a bigger bench will have to rule on the issue. This verdict is clearly trespassing on the fundamental right to free speech!

Congress has recruited lot of Bloggers and we can imagine how they can defame rival parties . This blogger was spreading lies. Bloggers claim to be so purely politically neutral and then abuse the Right Wing organizations.

Are you sure BJP/SS/RSS/SRS/BD havent recruited any bloggers? They do not spread lies/rumors about left wingers and centrists? I see membership in thousands for such rightwinger groups on online communities filled with filth and hatred.

Blogs are no different than our forum. Just the format is different and only one guy/gal writes something and others read and/or comment.

So many folks think blogs is news. Its not. Many think that writing negative or postive on a blog has great effect. No. Atleast not in a country like India where the majority still does not have access to the internet nor are they in the 'web informed' class of people who go to the voting booth. Majority of the literate people of India still rely on newspapers and to an extent on TV news.

I dont know why political parties get their underwears in a tight wad just because some blogger wrote something. The only people who will be affected are the internet savvy users, and the politicians do not consider this 'educated and informed' class as their core voter base anyway. So why all this brouhaha?

After 2004 elections where NDTV and rajdeep ran a subtle campaign to malign BJP for Gujrat riot,political parties are conscious now. 2004 election defeat,Media played a major role. So all parties are conscious now.
