Karishma's TV serial stayed by High Court.

Romance novelist spikes Karisma's mega-serial

Sahara TV's Monday launch of the Karisma Kapoor-starrer Karishma: Miracle of Destiny has been stayed by a High Court order, thanks to a complaint by bestselling romance novelist Barbara Taylor Bradford.

The author Barbara Taylor Bradford claimed that the entire TV serial is totally lifted from a novel "A Woman of Substance". Barbara Taylor Bradford and her husband flew down to Calcutta to secure an injunction/stay on this TV serial.

i don't think karishma will be able to go to court and say that it was an original idea( zara hatke shtyle!). it will probably be shelved or an out of court settlement reached. depends on how much money the other side demands.

Indian film maker accused of piracy

The novelist Barbara Taylor Bradford yesterday said she would seek hefty damages from a leading Indian television network after it allegedly "stole" the plot of her best-selling trilogy and began to air a TV series in defiance of a court injunction.

The fight by the British-born author is a rare legal challenge to piracy by India's film industry.

Ms Taylor Bradford said she learned indirectly of Sahara TV's plans to make a mammoth 260-episode series, called Karishma - Miracles of Destiny, last month. She became convinced the series planned to mirror the story-line of her best-known book, A Woman of Substance.

Ms Taylor Bradford successfully sought an injunction in the Calcutta courts on May 7. That was lifted by an appeal court, but reinstated on Monday night by India's Supreme Court.

The first episode was still aired on Monday. Yesterday the author and her husband claimed Sahara was in contempt.

Will Karishma - A Miracle of Destiny be aired on Sahara Manoranjan next week?

There is a strong possibility of that as the Kolkata court has removed the stay order on the airing of the serial in which Karisma Kapoor is making her small screen debut.

Sachin Bhaumik, the serial’s writer said, “We have won the first round. The court has given both the parties seven days for filing any further case in another court. If either party doesn’t the serial can go on air next week.”

Sahara’s officials Priya Raj, vice-president of publicity and Basavraj, vice-president programming operating from Mumbai had few details on the ruling. “We have yet not got the details of the court's ruling. We will get them by tomorrow,” said Basavraj.

When asked if the serial will be on air from next Monday if no further case is filed, he said, “We have to still take the decision on when the serial will go on air.”

One episode the high-budget soap was aired on May 12 after which the court passed a stay order on it.

A Woman of Substance author Barbara Taylor Bradford filed a case in the Indian court against the makers of this serial and Sahara for copyright infringement.

There is not much rejoicing in the Karishma camp, however, because insiders are expecting another case to be filed by Taylor Bradford.

Karishma - The Miracles of Destiny has been hyped as TV’s biggest serial ever.

The show is produced by actress Sheeba’s Cinetek Production, with husband Akashdeep as creative director. Siddharth Sengupta and Talat Jani are the episode directors.

Shot at various locations in Mumbai, a major part of it was also also shot in New Zealand.

Besides Karisma, it also stars Sanjay Kapoor, Arbaaz Khan, Arshad Warsi, Vikas Bhalla, Jugal Hansraj among others.

LONDON: Best-selling novelist Barbara Taylor Bradford has indicated she would continue her legal war against plagiarism by Sahara TV.

Just hours after the Kolkata High Court lifted an injunction on the broadcast of Karishma: A Miracle of Destiny, Bradford's spokesman pointedly told this paper: "The court decision is not final."

Bradford's Indian lawyers had been granted the right to appeal, the spokesman indicated, suggesting a continuation of Bradford's declared "wake-up call" and battle against alleged Bollywood's intellectual theft.

In a confusing take on the Kolkata judgment, which appeared to allow Sahara TV to air the Karishma Kapoor-starring soap from July 7, the spokesman added: "The injunction to stop the transmission and recording of Karishma: A Miracle of Destiny is still in place and will remain until an appeal court hearing".

Bradford took Sahara to court over alleged plagiarism of her 1979 best-seller, A Woman of Substance, which she claimed was sneakily converted into India's most-expensive and exotic soap opera.

Bradford and her film producer husband, are currently in London as part of the trans-Atlantic promotion of her 19th novel, Emma's Secret.

Just weeks ago, the author had told TNN she felt "intellectually raped" when she found out Karishma: A Miracle of Destiny was palpably based on the plot, characters and storyline of her first best-seller.

In an extended interview, the couple had said the tribe of Bollywood film producers were "stealing, pirating properties every hour on the hour. The writers grab a film, run it and copy the story in Hindi. Naturally our people in Hollywood are not conscious of that because they don't speak Hindi. But we know that's being done every day and I think everyone wants to fight".

The Bradfords also alleged Sahara TV was focussing on "legalities" rather than the big picture, that is allegations of intellectual theft.

it might take 100 mb of memory to just store the names n identities of those who have been indulging in this murky plagiarism activities n are most of them today are those who we call as stars n crave for them...kitne hi music nuggets ,movies n so many other things..u might have to open a seperate police to monitort this ...

I hate to say this but isn't life the same everywhere?

If a man loves a woman, sings songs to her, courts hers ,wooes her ,proposes to her, gets married, has fights, gets divorce.....



Now if somebody claims that this story is her intellectual property, how can it be??? Unless you use the exact same dialogues, background, description......likely to be in favor of Karishma.

Arey yaar

People have copied music and themes and stories before from Hollywood... Even within Hollywood sometimes some themes are lifted from other movies.. especially in B grade movies.. The fight scenes and the baravado of the lead hero is so cliched..

Yet... you cannot do a blatant copy and then say Yeah this is original. Just by changing names of characters but keeping same story will not help.
And worst is... if you can get away with it then you are a genius but if you get caught...
