Trump administration plans to end work permits for H-1B visa spouses

H-4 is issued to the spouse of H-1B visa holders, a significantly large number of whom are high-skilled professionals from India. A 2015 rule allows work permits for spouses who otherwise could not be employed while H-1B visa holders seek permanent resident status. Indian-Americans were a major beneficiary of this provision

WASHINGTON: The Trump administration is planning to propose to end allowing spouses of H1-B visa holders to work legally in the US, a top federal agency official has told lawmakers, a move that could have a devastating impact on tens of thousands of Indians.

The move to end the Obama-era rule could have an impact on more than 70,000 H-4 visas holders, who have work permits.

H-4 is issued to the spouse of H-1B visa holders, a significantly large number of whom are high-skilled professionals from India. They had obtained work permits under a special order issued by the previous Obama administration.

Indian-Americans were a major beneficiary of this provision. More than 100,000 H-4 visa holders have been beneficiary of this rule.

A 2015 rule issued by the Obama administration allows work permits for spouses who otherwise could not be employed while H-1B visa holders seek permanent resident status -- a process that can take a decade or longer.

The Trump administration is planning to terminate this provision. A formal communication is expected to be made later this summer, US Citizenship and Immigration Services (USCIS) Director Francis Cissna said in a letter to Senator Chuck Grassley.

"Our plans include proposing regulatory changes to remove H-4 dependent spouses from the class of aliens eligible for employment authorisation, thereby reversing the 2015 final rule that granted such eligibility," Cissna said.

He said such action would comport with the executive order requirement to "propose new rules and issue new guidance, to supersede or revise previous rules and guidance if appropriate, to protect the interests of United States workers in the administration of our immigration system ... "

As with other revisions to regulations, the public will have an opportunity to provide feedback during a notice and comment period, Cissna said.

According to a recent study by the Migration Policy Institute, the US has issued employment authorisation documents to more than 71,000 spouses of H-1B visa holders, over 90 per cent of whom are Indians.

"As of June 2017, USCIS had granted 71,287 initial (versus renewal) employment authorisation documents to H-4 spouses," the study which was released last week said.

Of those H-4 spouses with work authorisation as of early 2017, a total of 94 per cent were women, and the vast majority, 93 per cent, were from India, while four per cent were from China, the study said.

I live in the thick of the action - Silicon Valley... I have seen a change in quality of H1B fellows... These days anyone with a degree and 'fake' experience lands here and claims to be a specialist. Companies like Infosys, Cognizant, MPhasis, TCS just recruit anybody and get them here. They dont know half the things needed to do the job. H1B has become a racket in the last 5-6 years.

Back in 2008, one fellow (Gult, what else) was saying that he had a tough time finding a bride since no one was prepared to give their daughter to a 'Software guy working in US'.

But it's wrong to say that it affects all H-1Bs, only those that have a I-140 petition approved were eligible to apply for their spouse to get a work permit (H4 EAD).. so, it's not like all H4 spouses are allowed to work.

In USA forever spouses of work visa holders were not permitted to work, in Canada, UK, NZ, Australia, other countries that's not the case.

last 5-6 years? I thought it has been a racket since quite a long time... I know of a time when companies would run fairs to recruit people as freshies and one/two years experience. They wouldnt pay these guys when they were looking for a job - this ended up being a scandal and I know a few people who have claimed against these companies 8-10 years later and ended up getting load of $$.

Yups. from Apni Jawani ke din (91-92), I know of couple of guys whose deal with bidyshoppers was that they would get acco in Umrika with some basic money like $300 a month and their family in India would get Rs 5000 a month ( double of what Infy would pay those days). TCS was also one such bodyshopper.

Hasn't it always been so? Technologies have been moving at a very fast pace, companies choose an eclectic mix which nobody can fit 100% into..

Those that made money and positions earlier when there was lesser to no scrutiny.. are now playing like they are Harishchandra personified. Typical hypocrisy of Indians (now got US citizenship), especially the consultancy owners.

Recently this news came out, some gults were complaining Trump is screwing students also now.. I educated them that consultancies have used masters students on OPT to make millions.. earning 20-30 dollars an hour easy.. get 10-15 guys on jobs and you make 1M in 2 years. Looks like Wipro, Infy, TCS, Cognizant missed out on this model.

Having said that, of course many top employers are similarly using the summer intern program to get work done for 3-4 months by paying peanuts to students, all in the name of hiring local.

Reminds me of my own jawani ke din. 1992 - TCS had just launched EX (their accounting software) and I got an offer to join them (they needed FoxPro programmers). Heck, I refused

and somehow the myth spread that Infy and TCS only employ "First Class First Throughout" guys

Almost all companies are doing this, especially the big ones.. let's say they train you for java.. but projects are not coming through or whatever, so they push you into anything that has an opening. So there goes all the training in the waste bin.

If he gets visa next year, he should claim damages.

I had this colleague from Guntur with exact same name and situation except he got married in January, don't know about the dowry situation. But just to tease him I forwarded this to him asking if he was in the news.

Stop reading the hyped up news in Indian newspapers.

Read the H4 work visa related information on US sites.

Basically H4 visas were for spouses of H1B holders and were never allowed to work. President Obama used an executive order/directive and allowed H4 visa holders to work if their H1 spouse was already in the I-140 stage and had a EAD (employment authorization document). So a new type of H4-EAD came into existence. Note that the original law has not changed. Just a rider/supplement had been added to the law.

Now the new administration has just rescinded the original directive by the former President and so the law has gone back to its original state - No work visas for H4.

So this is not a change in the law but enforcing the original law and suspending/removing the rider/supplement

Also the requirements for companies to prove that an H1B candidate was needed were always there, just that they were never scrutinized and enforced to the letter. So earlier H1B was granted by default for 3 years despite all the provisions like ensuring there is work for that long, the skills match etc etc.

Right now Trump administration is enforcing the original requirements of the H1B via regulations.

India media has nothing better to do other than usual fake and biased news, so they paint the picture as if all Indians in IT industry are going to die due to some new virus!!
