Kill Bush Call lands Indian Student in US Jail
Man this guy's in for deep trouble. Vikram Buddhi, a Purdue University graduate student, who posted inflammatory messages on Yahoo's bulletin board has been arrested & charged with threatening to kill Bush, first lady Laura, Dick Cheney & even other top Republican leaders.

A Purdue University graduate student was arrested and charged with threatening to kill President George W. Bush, Laura Bush, Vice President Dick Cheney and Secretary of Defense Donald Rumsfeld.
Vikram Buddhi allegedly posted the detailed and threatening messages on an online message board.
Buddhi has been studying industrial engineering at the university, having moved temporarily from India to his new home in West Lafayette 10 years ago on a student visa. He was originally hired as a teaching assistant in the math department but was removed from that position and is now a teaching assistant in the industrial engineering department.
Since this is a very busy time for college students, being immersed in studying for their upcoming finals, Buddhi’s attorney John Martin said he hopes his client will be released from jail Wednesday following his detention hearing so he can return to studying.
Buddhi told investigators he posted the message, along with other derogatory messages aimed at the president, but Martin said Buddhi’s actions should be covered by the First Amendment since Buddhi would have never actually carried out his threats.
In the various messages posted, Buddhi urged the Web site’s readers to bomb the United States and for them to rape American and British women and mutilate them, according to court documents. Other messages called for the killing of all Republicans.
“What was allegedly said certainly is derogatory and may be inflammatory,” Martin said. “But there’s no real serious threat more than it was chat on the Web.”
Buddhi allegedly posted his messages on a Yahoo finance board dedicated to Sirius Satellite radio, a site that receives 2 million to 3 million hits a day, Martin said. A concerned citizen contacted the Secret Service office in Dallas to report that a subject was posting threatening messages about Bush, according to the criminal complaint filed in Hammond’s federal court and unsealed Monday.
Buddhi was arrested Friday and told investigators he is not suffering from any mental illnesses nor is he taking any illegal or prescription drugs.

NAVI MUMBAI: The scholarly Buddhi family has seen a lot of ups and downs in the last two decades. In 1988, senior defence scientist with the Indian navy Captain Buddhi K Subbarao was framed for allegedly leaking naval secrets.
The charges proved baseless, and he was acquitted in 1993. Now, Capt Subbarao's son Vikram Buddhi has been jailed in the US for allegedly posting an anti-Bush remark on the internet.
However, his NaviMumbaibased family firmly believes that Vikram is innocent and that someone has hacked into his net account to post the 'Kill Bush' message on the Yahoo finance board.
Talking to TOI, 65-year-old Capt Subbarao said, "Vikram has been studying applied mathematics at the University of Purdue for the last ten years. He is a quiet and docile sort of person and I feel someone has played mischief by posting an anti-American message using his name."
He, however, said he had full faith in the American judiciary and would not comment on the case investigation. "There is absolutely no connection or provocation for Vikram to say something like 'Iraqis kill Bush'. Why should he instigate Iraqis to do something like this," he asked.
Currently, Capt Subbarao is a supreme court advocate.

MUMBAI: Efforts to free the postgraduate Indian student, Vikram Budhi, from a US federal prison are now getting stronger with the alumni of IITs
coming together to press for his release.
Talking to TOI from Delhi, Supreme Court lawyer and member of IIT-Delhi senate Somnath Bharti said: "A very bright mathematics scholar, Vikram Budhi, who has also won an award for the best lecturer at University of Purdue, is languishing in a US jail without any evidence for over three years. So several IIT alumni under the umbrella organisation Pan-IIT will fight for justice in America."
Bharti added Pan-IIT, which has several influential members in the US, would also be having a detailed discussion with the ministry of external affairs so as to put pressure on America and seek justice for Budhi. "There are so many loopholes in the court trial. In fact, it is surprising how someone could be kept behind bars without a single hard evidence fact against him or her. We want a fair trial and justice for the Indian student," added Bharti.
Earlier, Budhi's father, Captain B K Subbarao, had said US Secret Service (USSS) officials had actually given in writing that the Purdue University student was not really a threat to the US leaders in February 2006.

A fight to help free the brilliant Indian PHD student Vikram Buddhi from a US prison has now gained national interest with even the Indian government is putting added pressure on the Obama administration to free Buddhi.
Speaking to TIMES NOW , the US Justice Department Spokesperson, blamed the Indians for the delay in the sentencing, saying Buddhi has repeatedly requested continuances, filed lengthy documents with the court raising numerous issues and has fired his attorney, all of which resulted in the court adjourning the case to a furthur date.
Earlier, the Indian government had responded to the call for justice by former Indian Navy captain Subbarao Buddhi for his son Vikram who has been languishing in jail in the US for allegedly writing an anti-Bush remark on the Internet. According to sources in the External Affairs Ministry, Foreign Minister S M Krishna is said to have met with Buddhi’s lawyers and promised to do his best.
Vikram Buddhi, a PHD student studying Math at Purdue University is now languishing in a US prison for posting an anti-Bush post he says he never wrote. His father, a former Indian Navy Captain has been fighting a lone legal battle to help his son and maintains he does not want mercy, but justice for his son.
India is said to have conveyed to the United States the possibility that the Purdue University website was hacked and that what was attributed to Buddhi may not even have been written by him. The Indian government has also pointed out that Buddhi remains in jail even though no sentence has been pronounced. In reply, the US government is understood to have told India that the case has been referred to the Justice Department which is directly responsible for the case.
Sources said that S M Krishna had met and assured the two lawyers dealing with the case that he would do his best, ironically the question of justice for Vikram is no longer in the hands of the US government now, but its own independent judiciary and as such, the Indian government cannot prevail upon the US state department to influence or interfere with its justice department.
Vikram was picked up from the Purdue University campus in April 2006 for allegedly posting an online threat to former US President George W Bush and others on a website. Though technically it has not been proved that he sent the threat message from the campus, he still remains in prison, awaiting a sentence.

He should suffer. Had he imagined saying the same thing against King Fahad if he was studying in Saudi Arabia. Leave aside Saudi Arabia,he would have restrained himself even in China and Russia. People should be made to face music some times. He should be made an example for others.

Even the most rabid leftists from Berkeley do not use death threat language against Republicans. They will go to any length and call all sorts of names and malign the Bush family, but they too know where to draw the line.
Another thing I have seen with some - not all - desi college students is that they think they are in their own college back home. They want to be part of all political committees and what not. You are here, study, get a degree and then stand on a street corner on a soapbox. Why waste your college years?
You are right, no on will dare say a word, even in jest, against any MIddle Eastern ruler or in Russia or China. USA allows complete freedom and so some ingrates abuse it.

1) I guess all the NRIs in US must've felt very insecure. But I am sure that the SS weren't looking specifically for an Indian or foreigners.. most probably they were generally scanning the internet.
2) The news report posted here says :Buddhi told investigators he posted the message, along with other derogatory messages aimed at the president, but Martin said Buddhi’s actions should be .. Sounds like a confession.
But, Recently I heard his mother on TV, saying that someone else posted it in his name and his father mentioning hacking.
3) Members here do post some pretty strong messages.. If we dig, I am sure we can find some equally, maybe even more, inflammatory messages.
4) In India, we have some pretty strong cases of undertrials languishing in prison for years.. Now, it appears that America has such cases too. I am assuming that this is ONE case that we have highlighted, because it pertains to an Indian. Surely there must be other cases too..
5) 3 years down the line, honestly, what are your feelings about this whole thing? Hasn't the poor bastard suffered enough? Maybe his initial 'confession' was given under duress.. Maybe ... i pray it doesn't ever .... it could happen to YOU, your id getting hacked and misused.

I understand what you are saying. However, even in the most angry moment one should not issue death threats to anyone, be it President or Prime Minister.
I know so many folks here who will talk so much against Pres Bush or Republicans. I respect their opinion but I have never heard them say abusive and threatening words.
This moron came here to pursue higher studies. If he was against US foreign policy and Pres. Bush vis-a-vis Iraq war, then he should have waited outside USA. Then after Pres. Bush's term was over and Obama was elected, he could have come here and pursued his education!

I want to note that in India, we perhaps won't be so strict.. Suppose you have a conversation on a BBS like :
A. Manmohan ko goli mar deni chahiye..
B. Tere baap ka raaj hai kya.
.......... end of the matter.......... perhaps the agencies, if they note it (though I guess they don't scan too many BBSs) will only mildly pursue it, as a crank call.
In USA too, they have thousands of such crank calls. This call was apparently singled out. Is there more to it? Despite the confession?

You are wrong, in USA every call, letter, email threat made to the President is investigated. Whether the threat is made by a crank person or not, the investigation does continue. Secret Service will come looking for every such threat made. So this one person was not singled out. He was surely one of the many 'crank' threats being investigated.

But do you think that the thousands of crank callers (per year) are languishing in jail for years without due process of justice? Or that the thousands are milder than this one? Was this call, as a threat to the President of USA, way stronger than the others?
Now, this fellow is inside for a) threat to president of usa, b) inflammatory statements regarding american society. Right?
But whatever, he has been denied a fair trial so far (as per the reports). Will it make the hardasses ashamed to speak for him to get him a fair trial? Just that. Give him the max, if you will, if he is guilty, but for God's sake, don't latkao him.

And in a way this should be an example to all foreign students - you have come here to the USA. So learn to respect and obey the laws of the land. And if you dont like the President or US foreign policy then get out and go to your ideal country and get your degree there.

I disagree! Even you are not a citizen of US, but you do criticize President Obama. Does that mean you should also pack up and go back to India? Why does US Constitution even have the 1st amendment then? Why boast about being the 'land of the free' if we cant criticize the govt and its functionaries?
I do agree that the accused in this case has gone a bit too far and making a threat against a President is certainly punishable by law. He deserves the punishment prescribed by the law. But that doesnt mean we all cannot talk against the govt or the president. Infact this country was founded on the principles of rebellion against a tyrannous govt.

New Delhi: IIT teachers and students today took out a candlelight march to demand release of Vikram Buddhi, an IIT alumnus who is in a US Federal jail since 2006 for allegedly posting anti-Bush remarks on a website.
The students raised slogans and demanded that Buddhi be released immediately. About 100 students and teachers participated in the protest march that continued for an hour, a student said.
External Affairs minister SM Krishna has assured the family of Buddhi that a fair trial has to be given to him and the Indian mission will take due care in this case.

CHICAGO: IIT alumnus Vikram Buddhi was on Friday sentenced to 57 months in prison and three years of supervised release for posting hate messages in 2006 to the then President George W Bush.
Buddhi, who was arrested in 2006, was sentenced by senior Judge James T Moody after being convicted of making threats to Bush, the then Vice President Dick Cheney and their wives, and calling for bombings of US infrastructure.
The 38-year old Phd student of Purdue University, will have to spend an additional three years under "supervised release" under the supervision of a probation officer, the court said.

Buddhi, who represented himself during the sentence hearing after firing his lawyer, said earlier that he was given the short end of the stick, and claimed the trial had been unfair.
Before the sentencing Buddhi submitted to the judge that he had got "ineffective assistance" of the counsel and said it was the "gravest error of justice".
Buddhi had on Thursday fired his lawyer Arlington Foley for not discussing the case properly, and said would "involuntarily represent himself" at the hearing.

Chicago: IIT alumnus Vikram Buddhi was today sentenced to four years and nine months in prison and an additional three years of supervised release by a US court for posting hate messages in 2006 against former president George Bush and calling for bombings of American infrastructure.
Indiana court district jdge James Moody said the supervised release would be monitored by a probation officer.
Buddhi was arrested in 2006 after being convicted of aking threats to Bush, the then Vice President Dick Cheney and their wives, and calling for bombings of US infrastructure.
The 38-year-old Phd student of Purdue University, convicted in 2007, had fired his lawyer yesterday when his sentencing hearing began. He represented himself in the court and said "the trial was unfair. I am not the kind of person the government is trying to portray".
After the sentence, Buddhi wearing an orange prison jumpsuit, spoke for a little while with his former lawyer. He was then taken into custody and led out of the courtroom. Buddhi has a right to appeal against the judgement in a Chicago court within 10 days.
Since Buddhi was representing himself, the notice of appeal can be filed through the court or by his previous lawyer Arlington Foley, whom he had fired but remained his stand-by counsel.
"Every person has a right to appeal. The court has asked me to ensure that (the notice of appeal) is filed," Foley told reporters after the sentencing.
Buddhi has been in jail since 2006 and Foley said the Bureau of Prisons would take that into account before determining the total time that he would now be required to spend in a US prison.
Typically if somebody is sentenced to 57 months, he would serve approximately 85 per cent of that time and "most likely" would be given credit for the months he has already spent in jail," Foley said adding that Buddhi has already spent a couple of years in jail and that could be deducted from his sentence of 57 months.
After completing his sentence, Buddhi could also be deported to India. While the deportation would be handled by a different authority in Chicago, Foley said if Buddhi is a candidate for deportation, the fact that "he is a convicted and the nature of the charge against him would weigh very heavily when the authorities determine whether he should be deported".
During the two-day sentencing hearing, Buddhi argue that since he had got "ineffective assistance" of the counsel and faced the "gravest error of justice", his sentence should be shortened. "I got the short end of the stick," he added.
Fighting his own case, the 38 year old Phd student from Purdue University tried hard to convince the judge and put up several arguments, even at the cost of making Moody impatient.
Moody ruled that he did not find the defendant's "arguments and the mitigating factors he presented persuasive enough" to give him a shorter sentence.
Not giving up, Buddhi repeatedly argued before the judge that that the messages posted on the internet were not "threats" but "just opinions" and if any unbiased persons had read the mails, they would notice that there is "no intention of inflicting any harm". "Every person has a right to his or her opinion," he said.
Anybody who goes to online message boards should read a warning that tells people that the messages are just opinion of the person posting them and should not be taken seriously for any other purposes, Buddhi argued.
He said he did not have anything against the US and "I support the war in Iraq and Afghanistan. "Those messages were posted just to challenge the mind, to cajole, to see what the effect would be if a different picture is presented.
US troops are killing Iraqis, Afghansitanis and the bad guys. If instead of saying US troops are killing Iraqis, it is said that Iraqis are killing US troops, the picture changes and becomes very dramatic".
He mentioned news reports of "US soldiers raping and killing young women" and how people are being "blindfolded" and torture tactics being used. "But just to challenge the mind, you turn the picture around. Many people don't view the picture from the other end," he said.
He stated he had a good educational background and had won awards while he was teaching mathematics at Purdue. Trying to strengthen his argument, Buddhi said he has many anglosaxan friends, had assisted war veterans, had never been to Iraq and attended the premier Indian Institute of Technology from where other graduates also come to the US.
